בשנת 2016 בוצעה בחוק הכשרות המשפטית והאפוטרופסות, תשכ"ב, 1962 רפורמה מקיפה המכונה תיקון 18. מטרת הרפורמה הייתה לצמצם את השימוש באפוטרופסות למינימום ההכרחי ולקדם חלופות מגבילות פחות, ובראשן קבלת החלטות נתמכת. לאור התפקיד המרכזי שממלאות העובדות הסוציאליות בתחום זה של כשרות משפטית, ערכנו סדרת מחקרים שמטרתם לבחון את תפיסותיהן ושיקוליהן של עובדות סוציאליות אשר נמצאות בקשר מקצועי עם אנשים עם מוגבלויות ועם תחום הכשרות המשפטית. במאמר זה נבקש לדון באופן אינטגרטיבי וממבט-על במשמעויות של ממצאי פרויקט המחקר, ונדון הן במטרות שהעובדות הסוציאליות מייחסות לאפוטרופסות (מניעת סיכונים וקידום איכות חיים) הן במאפיינים האישיים אשר הן מביאות בחשבון בהמלצותיהן (אבחון האדם, רמת תפקוד ורצון). דיון זה מראה לנו כי יש פער לא מבוטל בין החזון שביסוד תיקון 18 לבין התפיסות והפרקטיקות של העובדות הסוציאליות. פער זה מוביל אותנו לנסח המלצות אחדות ברמת ההכשרה והמדיניות, במטרה לקדם יישום מקיף ועמוק של הרפורמה ולאפשר לאנשים עם מוגבלויות ולאנשים זקנים לממש את זכותם לכשרות משפטית.

המאמר מציג מחקר איכותני הבוחן את משמעותה של האפוטרופסות עבור אנשים עם מוגבלות קוגניטיבית שמונה להם אפוטרופוס בן משפחה, ואת האופן שבו היא משפיעה על ההגדרה העצמית שלהם.   המחקר מתבסס על  ראיונות עם 13 צמדים של אנשים עם מוגבלות וקרובי משפחתם המשמשים אפוטרופוסים. הממצאים מצביעים על כך שלמרות שהאפוטרופסות נתפסת על ידי שני הצדדים כהסדר ברור מאליו, היא משפיעה על תחושת האוטונומיה והשליטה של האדם על חייו, ולעיתים מגבילה את הגדרה העצמית שלו, בעיקר בנוגע להתנהלות כלכלית. עם זאת, מתקיימים תהליכי מיקוח, תמיכה והתפתחות בהקשר של קבלת החלטות משותפת. החלק האחרון של המאמר מציע המלצות יישומיות לקידום הגדרה עצמית תוך שמירה על קשר תומך.

Shalem Foundation, the foundation for the development of services for people with intellectual and developmental disabilities (IDD) in local authorities, operates in various ways to integrate people with IDD into all areas of life in Israeli society, with the aim of enhancing their inclusion and improving their quality of life and that of their families. The current initiative aims to raise awareness of the phenomenon of verbal abuse experienced by people with intellectual and developmental disabilities and to provide this population with coping strategies. Verbal abuse against people with IDD is a phenomenon that is rarely discussed. However, unfortunately, people with IDD encounter verbal abuse in many everyday situations, making it crucial to address this issue, teach them and their supporters (parents, families, and professionals) how to recognize verbal abuse and how to respond to it. To achieve this, the "Verbal Abuse" training package was developed as a practical tool for professionals providing services to people with IDD. The package includes an explanatory video on the phenomenon, a series of simulation videos featuring scenarios of verbal abuse and three alternative coping responses (with actors with IDD), a presentation in simplified Hebrew and Arabic, and a professional guide in both languages. The guide aims to provide tools for using the simulation videos and facilitate discussions about verbal abuse and possible coping strategies. As part of the initiative, four workshops on the topic were conducted for service recipients (with IDD) by framework staff. The workshops aimed to expose service recipients and staff to the phenomenon of verbal abuse, provide a platform for self-expression and discussion, raise awareness, and present various coping strategies. To evaluate the success, impact, and challenges of the workshops and training package, an assessment of the initiative was conducted, which is presented in this document. The evaluation's objectives are to examine the workshops' contribution to service recipients and staff in terms of knowledge acquisition, awareness-raising, creating dialogue, and exposure to coping strategies. It also aims to assess the satisfaction of the facilitators regarding the workshops, the written guide, the presentation, and the videos. This evaluation study combines quantitative and qualitative methodologies to achieve its objectives. Five frameworks (vocational training centers) participated in the study, including nine workshop facilitators and 32 service recipients with mild to moderate intellectual disabilities, who answered the questionnaires (with support from a reference person). One of the frameworks included Arabic speakers. The workshops were conducted from January to April 2024. 86% of service recipients participated in all four workshops conducted by the facilitators. Data collection was carried out using three tools developed by the "Mikhlol" unit: a pre-workshop questionnaire for facilitators, a post-workshop questionnaire for service recipients, and an interview guide for facilitators. Data analysis was performed according to the nature of the information—quantitative data were analyzed using descriptive statistics, and qualitative data were analyzed using categorical content analysis to identify key themes. The evaluation findings are presented in this report from the perspectives of both service recipients and facilitators. Most respondents (91%) indicated that they chose to participate in the workshops for various reasons, such as the desire to acquire coping tools (f=8), curiosity and interest in learning new topics (f=7), a specific interest in learning about verbal abuse (f=6), and enjoyment and interest in shared activities (f=4). Participants' knowledge and awareness of verbal abuse were assessed through several means. When asked to define verbal abuse, participants identified several categories: using inappropriate language (f=16), using swear words (f=13), verbal harm, insult, and humiliation (f=11), yelling or raising one's voice (f=8), and distinguishing between verbal and physical abuse (f=3). Regarding whether they learned new things about verbal abuse during the workshops, three main themes emerged: how to engage in respectful and non-harmful communication (f=9), managing responses and coping with situations (f=9), and gaining a deeper understanding of verbal abuse (f=3). However, six participants reported that the workshops did not provide them with new information. Participants were also asked how they would respond to verbal abuse. Their responses were categorized into five main strategies: reporting to an authority figure such as an instructor or manager (f=14), ignoring or distancing themselves from the situation (f=10), responding calmly and non-violently (f=8), reflecting on the situation and expressing feelings to the abuser (f=3), and responding in kind (f=2). Consistency checks confirmed the reliability of participants' responses.

במטרה להעריך את מידת ההצלחה, התרומה והאתגרים של הסדנאות ושל מארז ההדרכה, בוצעה הערכה למיזם זה, אשר מוצגת במסמך זה.

מטרת מחקר ההערכה הייתה לבחון את מידת ההצלחה והתרומה של הסדנאות להתמודדות עם אלימות מילולית עבור מקבלי השירות והמנחים. המחקר, שבוצע על ידי יחידת 'מכלול' של קרן שלם, נערך ב-5 מסגרות בהשתתפות 32 מקבלי שירות ברמת מוגבלות קלה-בינונית ו-9 מנחים, בין ינואר לאפריל 2024.

הממצאים הצביעו על כך ש-91% מהמשתתפים בחרו להשתתף בסדנאות מתוך רצון לרכוש כלים להתמודדות ולהבין את נושא האלימות המילולית. המשתתפים דיווחו על למידת דרכי תגובה, כולל פנייה לגורם מוסמך (f=14) ותגובה רגועה (f=8).

يُعنى مشروع "التأهيلات القانونية" بتطوير المعرفة في مجال تطبيق التعديل رقم 18 لقانون الأهلية القانونية والوصاية، وذلك لصالح الأخصائيين الاجتماعيين في السلطات المحلية. شهدت السنوات الأخيرة تطوراً قانونياً كبيراً في البلاد وحول العالم في مجال الأهلية القانونية للأشخاص ذوي المحدوديات، وخاصة الأشخاص ذوي المحدوديات الذهنية التطورية، وهو ما تم توثيقه في التعديل رقم 18 لقانون الأهلية القانونية والوصاية لعام 2016. أظهرت أبحاث حديثة وجود فجوة كبيرة بين المعرفة النظرية والتطبيق العملي في الواقع. عند اتخاذ الأخصائيين الاجتماعيين قرارات تتعلق بالأهلية القانونية، تبرز إشكالية في تطبيق مبادئ التعديل رقم 18، حيث تُبنى القرارات غالباً على معايير قديمة دون إيلاء الاهتمام الكافي لمبادئ الإرادة والاستقلالية (لمزيد من التفاصيل، راجع الفصل التمهيدي). لذلك، يتمثل هدف المشروع في تطوير أدوات تمكّن من تحقيق وتعزيز المبادئ التي وردت في التعديل رقم 18، وضمان حق الأشخاص ذوي المحدودية الذهنية التطورية في الأهلية القانونية. الجهة المختارة لتفعيل المشروع هي "العيادة الحقوقية لحقوق الأشخاص ذوي المحدودية".

The Legal Competency Project, led by the Disability Rights Clinic, Faculty of Law, Bar-Ilan University, in collaboration with the Ministry of Welfare and Social Affairs and the Shalem Foundation, focuses on developing knowledge in the implementation of Amendment 18 to the Legal Competency and Guardianship Law for social workers in local authorities. The project's goal is to develop tools that will enable the realization and promotion of the principles established in Amendment 18, as well as the right of individuals with intellectual and developmental disabilities to legal competency. As a preliminary step toward developing the tool, workshops were conducted for social workers by the Disability Rights Clinic team (Faculty of Law, Bar-Ilan University) with the aim of introducing participants to the field, gathering dilemmas and case studies, and identifying key barriers. At the end of the workshops, a feedback questionnaire developed by the 'Michlol' Unit of the Shalem Foundation was administered. This document presents the findings from the feedback, along with a summary and insights drawn from it.

The purpose of the current survey is to provide a snapshot and serve as a knowledge base for creating a tailored training program (including the development of support tools) for women with intellectual or cognitive disabilities who are about to get married. The survey questionnaire, found in Appendix 1, was developed by the ‘Michlol’ Unit (of the Shalem Foundation) in collaboration with the project’s steering committee. The questionnaire, built on the Google Forms platform, was distributed via WhatsApp and emails to bridal counselors and mikveh attendants in June 2024 by representatives from the Ministry of Religious Services and the Eden Association. The quantitative and qualitative data, received digitally from 71 survey respondents, was processed and analyzed by the ‘Michlol’ Unit and is presented in this document.
